Seeing that it is an index it does NOT host, link to, provide or engage in the uploading of any of the files listed.TorrentFunk is an automated website that uses Google to find Bittorrent websites on the internet. These websites are then crawled by bots and information about their files saved are to the database. Again, this is information ABOUT the files, also known as the .torrent files. The actual file itself is not stored on our servers.

We have little control over our automated indexing process.We do however fully comply with the Digital Millennium Copyright Act (DMCA). Infringement notices are treated with our highest priority and we take appropriate actions to protect copyright holders' rights.

If your copyrighted material has been indexed by TorrentFunk, you can request its removal by sending us an infringement notice. However, these notices have to follow a few important steps to allow us to process them. Please read the steps below carefully. Incomplete/invalid notices cannot be processed by us!

1. Infringing Content
   Write an email and specify the page on TorrentFunk.com where you believe copyrighted material has been infringed upon. For example: "The copyrighted work appears on http://www.torrentfunk.com/tor/123/abc.html".
2. Check Content
   Make sure that the content you identified above is an actual torrent file or image. Dynamically created advertisements and search result pages cannot be deleted.
3. Contact Information
   Provide us sufficient contact information so that we may contact you (name and email address is required).
4. Evidence
   Provide us with evidence that you own the copyright to said content.
5. Good Faith
   Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."
6. Declare Under Oath
   Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
7. Email
   Email all the information to . (If you send it to another email it won't be responded to.)

TorrentFunk.com will act on all removal requests in a timely matter, as long as you provide the information we have requested.

We will verify the information that you send us and get the content removed if we accept your DMCA notification.
Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights.

Indeed, in a recent case (please see http://www.onlinepolicy.org/action/legpolicy/opg_v_diebold/ for more information), a company that sent an infringement notification seeking removal of online materials that were protected by the fair use doctrine was ordered to pay such costs and attorneys fees.
